28 people accused in the “Panama Papers” are acquitted

The ruling exonerates the law firm Mossack Fonseca and its collaborators

The Second Panamanian Criminal Cases Court, headed by Judge Baloísa Marquínez, acquitted the 28 people accused in the emblematic cases of “Lava Jato” and “Panama Papers” on Friday night.

The Panamanian press points out that the sentence exonerates the law firm Mossack Fonseca, its collaborators and citizens of German nationality, who were facing charges for the crime of money laundering.

According to Judge Marquínez, in the Lava Jato case, it was not possible to determine the entry of money from illicit sources, coming from Brazil, into the Panamanian financial system with the purpose of hiding, covering up, dissimulating or helping to evade the legal consequences of the preceding crime.

Regarding the Panama Papers, the evidence collected on the servers of the Mossack Fonseca law firm could not be determined, because according to the lawyer “they did not comply with the principles that govern digital evidence (…) and that would allow us to be certain of its authenticity. and integrity”, quotes Telesur

Likewise, the judge determined that the rest of the evidence was not sufficient and conclusive to determine the criminal responsibility of the accused.

Panama Papers

In April 2016, more than a hundred media outlets from at least 75 countries simultaneously disseminated thousands of financial documents that revealed tax havens of some of the richest and most powerful public figures in the world.

According to Panamanian prosecutors, the Mossack Fonseca law firm and its associates were responsible for creating a network of offshore companies to hide money linked to illicit activities, many of them related to the Lava Jato corruption scandal of the Brazilian construction company Odebrecht.

Some of the shell companies created by the company had been used to commit fraud, evade taxes or avoid international sanctions.
